Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the Driver Konnect website and platform ("the Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Safe and responsible use

You agree to use the Site in a safe, lawful and responsible manner. Specifically, you must not:

• Use the Site for any illegal, fraudulent or harmful purpose.
• Harass, threaten, defame or discriminate against any other user.
• Post false, misleading or inaccurate information about yourself, a vehicle or driving history.
• Attempt to access, disrupt or damage the Site, its servers or its data.
• Scrape, copy or redistribute content from the Site without permission.
• Use automated tools, bots or scripts to interact with the Site.
• Share another person's personal information without consent.

We may suspend or terminate your account if we reasonably believe you have breached these rules.

3. Accounts and eligibility

You must provide accurate and complete information when creating an account. You are responsible for keeping your login credentials secure and for all activity under your account. You must be at least 18 years old and legally entitled to work or hire in South Africa.

4. Platform role

Driver Konnect is a connection platform. We are not an employer, employment agency, insurer or party to any agreement between vehicle owners and drivers. Any engagement, contract or working arrangement is entered into directly between the owner and driver.

5. Credit purchases and payments

Certain features or actions on the Site may require the purchase of credits or other paid services. All prices are shown in South African Rand (ZAR) inclusive of VAT where applicable.

6. Payment, fees and refund policy

6.1 Fees

Certain services on Driver Konnect, including but not limited to profile unlocks, credit purchases, subscriptions and advertising features, require payment of fees. All fees are displayed on the platform at the time of purchase and are payable in South African Rand (ZAR), inclusive of VAT where applicable.

6.2 Payment methods

Payments are processed securely through our payment provider(s), including but not limited to PayFast. By making a payment, you agree to the terms and conditions of the applicable payment provider.

6.3 Authorisation

By providing your payment details and confirming a purchase, you authorise Driver Konnect (through its payment provider) to charge the applicable amount to your chosen payment method.

6.4 No refunds

Except where required by South African law (including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002), all payments made to Driver Konnect are final and non-refundable. This includes, without limitation:

• Credit purchases
• Profile unlock fees
• Subscription fees
• Promotional or advertising payments
• Any other paid features or services on the platform

Because Driver Konnect provides a digital service that is delivered immediately upon purchase (including access to unlocked driver information), you acknowledge and agree that the statutory cooling-off period does not apply.

6.5 Exceptional refunds

Refunds may be considered, at Driver Konnect's sole discretion, only in the following limited circumstances:

• Where a payment was processed in error due to a verified technical fault on the platform.
• Where a duplicate charge was incurred due to a platform or payment gateway error.
• Where a refund is required by applicable South African law.

Requests must be submitted in writing to support@driverkonnect.co.za within 7 (seven) days of the transaction, together with proof of payment and a description of the issue. Refunds will not be granted for change of mind, dissatisfaction with a driver, unsuccessful hiring outcomes or failure to use purchased credits.

6.6 Chargebacks

Any fraudulent or unjustified chargeback initiated against Driver Konnect may result in immediate suspension or termination of your account and may be reported to the relevant authorities.

6.7 Expiry of credits

Unused credits remain valid on your account until used, unless otherwise stated in a specific promotion. Credits have no cash value and are not transferable, exchangeable or redeemable for cash.

6.8 Price changes

Driver Konnect reserves the right to change its fees, pricing structures or promotional offers at any time. Changes will apply prospectively and will not affect purchases already completed.

6.9 Acknowledgement

By making a payment on Driver Konnect you acknowledge that you have read, understood and agreed to this Payment, Fees and Refund Policy.

7. Cancellations

You may cancel or close your account at any time by contacting support. Cancellation does not entitle you to a refund of any unused credits or prepaid amounts. Any outstanding obligations between users (for example, a driver and vehicle owner) must be settled directly between those parties.

8. Content and intellectual property

All content on the Site, including text, logos, graphics and software, is owned by or licensed to Driver Konnect. You may not reproduce, modify or distribute it without our written permission.

9. Limitation of liability

To the fullest extent permitted by law, Driver Konnect is not liable for any direct, indirect, incidental, special or consequential loss arising from your use of the Site or any arrangement formed through it. You use the Site at your own risk.

10. Changes to these Terms

We may update these Terms from time to time. The latest version will always be available on this page. Continued use of the Site after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be resolved in the competent courts of South Africa.
